_Resumen:_ Al interior de la tradición clásica del derecho natural, los teólogos escolásticos de los siglos xvi-xvii describen ese derecho como simplemente necesario, así como inmutable y universal. Lo describen, además, como un orden objetivo, independiente de la voluntad de Dios. Sin embargo, no todos los teólogos escolásticos entienden la inmutabilidad del derecho natural de la misma forma, ni llaman “derecho natural” exactamente a lo mismo: para unos este es el “derecho de la naturaleza”, mientras que para otros es el (...) “derecho de la razón natural”. El artículo, así, aborda las principales diferencias que existen en las teorías de estos escolásticos sobre el derecho natural. (shrink)

Grotius’s theory of the foundations of law and morality follows a sort of middle way between rationalism and voluntarism. Grotius, far from both extremes, defends both the normative force of the will and the directive power of practical reason. On this basis, he explains that reason serves as the formal cause of law and the will as the efficient cause. Now, the command of the will alone is not yet valid as a law. It must conform to reason. The present paper describes how Fernando de Roa, professor at the University of Salamanca in the 15th century, received Aristotle’s practical philosophy. This article expounds his interpretation on three main topics of classical ethics and politics: justice as a social virtue, natural servitude and happiness as the end of man. In this paper, we introduce a dialogue between (post-)phenomenological and decolonial approaches to propose a sentipensante ethics. Emancipating from hegemonic approaches to ethics that privilege rationality over feeling bodies, we conceptualise an analogical ethics of virtues that emerge in the framework of an analectic-responsive experience. In this experience, we specify the affective, interoceptive, and inter-bodily aspects as elements of a sentipensante ethics from an enactivist perspective. This exercise allows us to highlight the foundation of the ethical experience as a participatory (...) virtue-making oriented towards solidary well-being. Finally, it invites us to search for pedagogical practices that cultivate this virtue-making. En este artículo introducimos un diálogo entre enfoques (post-)fenomenológicos y decoloniales para proponer una ética sentipensante. Nos emancipamos de perspectivas hegemónicas que privilegian la racionalidad sobre los cuerpos que sienten, y conceptualizamos una ética analógica de virtudes que emergen en el marco de una experiencia responsiva analéctica. De esta experiencia, precisamos los aspectos afectivos, interoceptivos, e inter-corporales, como elementos de una ética sentipensante desde una perspectiva enactivista. Este ejercicio nos permite resaltar el fundamento de la experiencia ética como un hacer-virtud participativo orientado hacia el bienestar solidario. El problema ético de la huelga de hambre ha dado cabida a soluciones contrapuestas, incluso en el contexto de teorías éticas que rechazan el suicidio. Algunos piensan que la sola honestidad del fin subjetivo basta para justificar la acción del huelguista. Otros, aunque son minoría, sostienen que la huelga de hambre es un acto reprobable per se, porque implica un atentado directo contra la vida o salud del sujeto. En este trabajo se defiende esta última interpretación. A juicio de los (...) autores, la huelga de hambre es un caso de suicidio intencional. Luego, nunca es lícito, bajo ningún aspecto, llevar adelante una acción de esta naturaleza. (shrink)

Ragpickers are people who salvage usable items from other person’s rubbish, and they are spread over different localities all around the world. This raises numerous issues related to the dignity of human life, and the right to education. In addition to discussion of these issues, this paper includes an interview study on bioethics of 150 ragpickers engaged in collection of papers, bottles, waste plastic materials, scrap iron materials and so on in Tiruppur city, Tamil Nadu, India. Ragpickers are mostly children (...) below 14 years of age. The objectives of the study were to find out the socioeconomic conditions of ragpickers, to examine the effect of environment on their health conditions and to identify their problems at work. Society as a whole regards rag picking children as anti-social elements, an embarrassment to the community and unfit to live. However their useful contribution to society and ecology is little understood and generally ignored. The waste collected by these children is recycled and produces 25% of writing paper, the packing materials, egg trays, economic plastic and metal house hold items, and so on, used in our homes. Society and ecology benefit from the production of cheaper household goods, and the slowing down of the destruction of the already threatened rain forests. It also helps to prevent the mountains of putrifying waste materials from building up in city centres. The ragpickers valuable contribution to society should not be ignored and taken for granted. There are a number of ethical and human rights issues raised by this practice, which should not be condoned as ethically acceptable social attitudes to a child’s life. (shrink)

Previous evidence has shown that excessive valuing happiness may relate to lower psychological wellbeing across cultures. Considering the lack of data with Spanish population, we examined the relation between tightly holding happiness emotion goals and subjective wellbeing in a sample of Spanish women, and explored the mediation role exerted by psychological inflexibility components in the relation between valuing happiness and subjective wellbeing. A female adult sample filled out measures of excessive valuing happiness, psychological inflexibility, positive affect, negative affect, and life (...) satisfaction. Valuing happiness only showed positive total effects on negative affect and strong direct effects on both cognitive fusion and experiential avoidance. Analyses revealed the mediating roles exerted by psychological inflexibility components, with experiential avoidance leading to lower pleasure; and cognitive fusion leading to greater displeasure and lower life satisfaction. Psychological inflexibility components explained between 40 and 80% of the total effect of valuing happiness on our outcome variables. Our findings highlight the need for further research on the benefits of hedonic vs. values-based approaches to happiness. (shrink)

Para todos los autores clásicos, el derecho positivo encuentra su origen en los principios universales del derecho, que Santo Tomás ha llamado lex naturalis. Pero estos principios universales del derecho son tan generales e inespecíficos, que para formar parte de un ordenamiento jurídico concreto (en una comunidad política concreta) necesitan de alguna especificación. This paper identifies and addresses persistent gaps in the consideration of ethical practice in ‘technology for good’ development contexts. Its main contribution is to model an integrative approach using multiple ethical frameworks to analyse and understand the everyday nature of ethical practice, including in professional practice among ‘technology for good’ start-ups. The paper identifies inherent paradoxes in the ‘technology for good’ sector as well as ethical gaps related to (1) the sometimes-misplaced assignment of virtuousness to an individual; (2) difficulties in (...) understanding social constraints on ethical action; and (3) the often unaccounted for mismatch between ethical intentions and outcomes in everyday practice, including in professional work associated with an ‘ethical turn’ in technology. These gaps persist even in contexts where ethics are foregrounded as matters of concern. To address the gaps, the paper suggests systemic, rather than individualized, considerations of care and capability applied to innovation settings, in combination with considerations of virtue and consequence. This paper advocates for addressing these challenges holistically in order to generate renewed capacity for change at a systemic level. (shrink)

A number of contemporary philosophers of mind have brought considerations from the study of aspect to bear on the ontological question how perceptual experiences persist over time. But, apart from rare exceptions, relatively little attention has been devoted to assess whether the way we talk about perceptual occurrences is of any relevance for discussions of ontological matters in general, let alone discussions about the ontological nature of perception. This piece examines whether considerations derived from the study of lexical aspect have (...) a significant bearing on what ontological views of perception we should endorse: I shall argue that such aspectual considerations are in fact of very little use for settling the relevant ontological issue. Empirical-ethical research constitutes a relatively new field which integrates socio-empirical research and normative analysis. As direct inferences from descriptive data to normative conclusions are problematic, an ethical framework is needed to determine the relevance of the empirical data for normative argument. While issues of normative-empirical collaboration and questions of empirical methodology have been widely discussed in the literature, the normative methodology of empirical-ethical research has seldom been addressed. Based on our own research experience, we discuss one aspect of this normative (...) methodology, namely the selection of an ethical theory serving as a background for empirical-ethical research. En este trabajo se intenta presentar la doctrina que tiene fray Luis de León sobre la determinación del derecho natural. Se propone que León no sólo debe ser considerado como uno de los principales representantes de la literatura española, sino como uno de los grandes juristas de la Neoescolástica del siglo XVI.

Las investigaciones sobre Luis de León se han centrado, sobre todo, en su mística, narrativa y teoría literaria. En este trabajo, el autor intenta desarrollar los principales aspectos de su teoría jurídica. Al igual que otros grandes teólogos de la Escuela de Salamanca, también León ha estudiado el problema de la naturaleza de la ley humana y su vinculación con el derecho natural. In this paper, the author attempts to develop the principal aspects of his legal doctrine. El presente trabajo intenta mostrar la naturaleza de la determinatio. El iusnaturalismo clásico la concibe como uno de los modos de derivarse la ley humana desde la ley natural, especialmente como el modo de derivación del derecho positivo o simplemente legal. Si bien Santo Tomás y los escolásticos tratan este problema, no detallan, sin embargo, el procedimiento y modalidad de la determinación. De ahí que nos parezca pertinente el estudio de este modo de crearse el derecho y la ley.

We explored the home learning environments of 173 Mexican preschool children in relation to their numeracy performance. Parents indicated the frequency of their formal home numeracy and literacy activities, and their academic expectations for children’s numeracy and literacy performance. Children completed measures of early numeracy skills. Mexican parent–child dyads from families with either high- or low-socioeconomic status participated. Low-SES parents reported higher numeracy expectations than high-SES parents, but similar frequency of home numeracy activities. In contrast, high-SES parents reported higher frequency (...) of literacy activities. Path analyses showed that operational numeracy activities were positively related to children’s numeracy skills in the high- but not in the low-SES group. These findings improve the understanding of the role of the home environment in different contexts and provide some insights into the sources of the variable patterns of relations between home learning activities and children’s numeracy outcomes. They also suggest that SES is a critical factor to consider in research on children’s home numeracy experiences. (shrink)

While the relation between visualization and scientific understanding has been a topic of long-standing discussion, recent developments in physics have pushed the boundaries of this debate to new and still unexplored realms. For it is claimed that, in certain theories of quantum gravity, spacetime ‘disappears’: and this suggests that one may have sensible physical theories in which spacetime is completely absent. This makes the philosophical question whether such theories are intelligible, even more pressing. And if such theories are intelligible, the (...) question then is how they manage to do so. In this paper, we adapt the contextual theory of scientific understanding, developed by one of us, to fit the novel challenges posed by physical theories without spacetime. We construe understanding as a matter of skill rather than just knowledge. The appeal is thus to understanding, rather than explanation, because we will be concerned with the tools that scientists have at their disposal for understanding these theories. Our central thesis is that such physical theories can provide scientific understanding, and that such understanding does not require spacetimes of any sort. Our argument consists of four consecutive steps: (a) We argue, from the general theory of scientific understanding, that although visualization is an oft-used tool for understanding, it is not a necessary condition for it; (b) we criticise certain metaphysical preconceptions which can stand in the way of recognising how intelligibility without spacetime can be had; (c) we catalogue tools for rendering theories without a spacetime intelligible; and (d) we give examples of cases in which understanding is attained without a spacetime, and explain what kind of understanding these examples provide. This work formalizes an informant-based structured argumentation approach in a multi-agent setting, where the knowledge base of an agent may include information provided by other agents, and each piece of knowledge comes attached with its informant. In that way, arguments are associated with the set of informants corresponding to the information they are built upon. Our approach proposes an informant-based notion of argument strength, where the strength of an argument is determined by the credibility of its informant agents. Moreover, we (...) consider that the strength of an argument is not absolute, but it is relative to the resolution of the conflicts the argument is involved in. In other words, the strength of an argument may vary from one context to another, as it will be determined by comparison to its attacking arguments (respectively, the arguments it attacks). Finally, we equip agents with the means to express reasons for or against the consideration of any piece of information provided by a given informant agent. Consequently, we allow agents to argue about the arguments’ strength through the construction of arguments that challenge (respectively, defeat) or are in favour of their informant agents. (shrink)

The recent debate about whether gauge symmetries can be empirically significant has focused on the possibility of 'Galileo's ship' types of scenarios, where the symmetries effect relational differences between a subsystem and the environment. However, it has gone largely unremarked that apart from such Galileo's ship scenarios, Greaves and Wallace (2014) proposed that gauge transformations can also be empirically significant in a 'non-relational' manner that is analogous to a Faraday-cage scenario, where the subsystem symmetry is related to a change in (...) a charged boundary state. In this paper, we investigate the question of whether such non-relational scenarios are possible for gauge theories. Remarkably, the answer to this question turns out to be closely related to a foundational puzzle that has driven a host of recent developments at the frontiers of theoretical physics. By drawing on these recent developments, we show that a very natural way of elaborating on Greaves and Wallace's claim of non-relational empirical significance for gauge symmetry is incoherent. However, we also argue that much of what they suggest is correct in spirit: one can indeed construct non-relational models of the kind they sketch, albeit ones where the empirical significance is not witnessed by a gauge symmetry but instead by a superficially similar boundary symmetry. Furthermore, the latter casts doubt on whether one really abandons Galileo's ship in such scenarios. (shrink)

Comparative study of the knowledge of IVF in medical students of universities with different ethical and humanistic valuesEstudo comparativo do conhecimento das técnicas de reprodução assistida em estudantes de Medicina de universidades com diferentes ideários éticos e humanísticosIn vitro fertilization continues to be presented as a relatively simple solution to produce a pregnancy without exposing the medical and ethical problems that this represents. This project consisted of conducting a survey to medical students from three medical schools in Mexico City with (...) different ethical and humanistic ideas with the aim of evaluating knowledge about IVF techniques and their ethical implications. The survey was applied to 404 medical students. Students in schools with personalistic ethics had a greater recognition of the bioethical principles involved in the use of these techniques. Grounding on person–job fit theory, we examined perceived overqualification relation with counterproductive work behavior by identifying job boredom as a mediator and job crafting as a moderator. Hierarchical linear regression and Hayes’ PROCESS macro-method were used to assess hypotheses in a three-wave survey of 317 textile sector employees. The findings show that perceived overqualification is positively related with CWBs. This study further examined the mediating function of job boredom and the moderating impact of job crafting in the association between perceived (...) overqualification and CWB. The findings suggest that job crafting moderates the positive relation between perceived overqualification and job boredom and the indirect connection between perceived overqualification and CWB via job boredom. The model was tested using 3-wave data; however, since the data were attained from a single source, questions of common method bias cannot be ruled out. Managers should look for changes in employee attitudes and promptly modify employees’ positions when they indicate that they have more experience, abilities, and talents required for their roles in their organizations. Richard Swinburne is one of the most influential contemporary proponents of the analytical philosophy of religion. He is, above all, a traditional theist. However, his interests are very wide-ranging. He has written about nearly all central theological and philosophical issues such as epistemology, metaphysics, theory of mind and ethics. During the “Münstersche Vorlesungen 2007” students and faculty members of the Department of Philosophy at Münster University entered into a skilful and interesting discussion concerning most of Swinburne’s positions.
